Effective Date: January 1, 2026
By accessing or using the website at asphaltpavingantioch.com (the "Site"), or by requesting, scheduling, or receiving services from Antioch Asphalt Paving ("we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use this Site or our services.
These Terms apply to all visitors, customers, and others who access the Site or engage our services.
Antioch Asphalt Paving provides asphalt paving, sealcoating, repair, striping, and related services to residential and commercial property owners in Antioch, CA and surrounding areas. The specific scope of work for any project is defined in a written estimate or contract provided before work begins.
We reserve the right to decline any project at our discretion and to subcontract portions of a project to qualified tradespeople when appropriate.
All estimates are provided in writing following an on-site assessment and are valid for 30 days from the date of issuance unless otherwise noted. An estimate is not a binding contract until you accept it in writing or by authorizing us to proceed.
Prices may change after 30 days due to material cost fluctuations or changes in project scope. If conditions discovered during work require additional labor or materials beyond the original estimate, we will notify you before proceeding and provide a revised quote for your approval.
We do not guarantee that estimates provided verbally or informally match the final written quote, which is the binding reference document for pricing.
Job scheduling is confirmed in writing or by phone once a written estimate is accepted. We will notify you of any scheduling changes as soon as possible. Weather, material availability, or other factors outside our control may require rescheduling, and we will communicate any such changes promptly.
If you need to cancel or postpone a scheduled job, please contact us as early as possible. Cancellations made less than 48 hours before a scheduled start time may result in a fee to cover mobilization costs, as specified in your written estimate or contract. We reserve the right to reschedule jobs that are cancelled repeatedly or on short notice.
Payment terms are as specified in your written estimate or contract. Unless otherwise agreed in writing, final payment is due upon project completion. We accept payment by check, cash, or methods specified at the time of contracting.
We do not require full payment upfront for standard projects. If a deposit is required for materials on a large project, that will be clearly stated in the written estimate. Invoices not paid within 30 days of the due date may be subject to a late payment fee as specified in your contract, plus any reasonable collection costs.
We stand behind the quality of our work. If a defect in workmanship is identified after project completion and is reported to us within a reasonable time, we will evaluate the issue and, where the defect is attributable to our work, repair or correct it at no additional charge.
This workmanship commitment does not cover damage caused by normal wear and tear, improper use of the surface, acts of nature, soil movement beyond what is reasonably addressed during base preparation, or modifications made to the work by you or a third party. Material warranties, if any, are subject to the terms of the manufacturer or supplier and are passed through to you to the extent permitted.
The information and content on this Site are provided "as is" and for general informational purposes only. We make no warranties, express or implied, regarding the accuracy, completeness, or fitness for a particular purpose of any content on the Site. Nothing on this Site constitutes professional engineering or legal advice.
Asphalt and paving services are subject to environmental and site conditions that may affect the outcome of work. We do not guarantee specific performance outcomes or longevity beyond the workmanship commitment described in Section 6.
To the fullest extent permitted by applicable law, Antioch Asphalt Paving shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of this Site or our services, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising out of services provided shall not exceed the amount you paid us for the specific project to which the claim relates.
You are responsible for ensuring that work areas are accessible on the scheduled date - vehicles removed, utilities marked, and entry gates unlocked. If the site is not accessible as agreed, we may need to reschedule and a mobilization fee may apply.
You are responsible for informing us of any known underground utilities, irrigation lines, or other obstructions in work areas before we begin. We will take reasonable care, but we are not liable for damage to unmarked or undisclosed underground infrastructure.
If your property is subject to HOA rules or requires permits, it is your responsibility to obtain any necessary approvals before work begins, unless we have explicitly agreed in writing to handle that step.
If a dispute arises in connection with your use of this Site or any services provided by Antioch Asphalt Paving, we encourage you to contact us first so we can attempt to resolve the matter informally. Most issues can be resolved quickly with direct communication.
If informal resolution is not successful, any dispute shall be subject to binding arbitration under the rules of the American Arbitration Association, conducted in Antioch, California. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.
You waive any right to bring a class action or participate in a class-wide arbitration proceeding related to these Terms or our services.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes not resolved through arbitration shall be subject to the exclusive jurisdiction of the courts located in California.
